The Commission edited and approved an updated draft that establishes jurisdiction over land within 100 feet of resource areas including lakes, ponds, and banks, with specific sections for isolated wetlands, intermittent streams, and vernal pool habitat protected by 100-foot setbacks. Member Jennifer Fanning raised concerns about enforcement penalties, leading the Commission to revise the draft to allow "up to $300 per day" in fines, giving the Commission discretion in penalty setting rather than imposing a flat rate.
